The Argeș Chamber of Commerce, Industry, and Agriculture (CCIA Argeș), as an authorized agent of the operator, the Chamber of Commerce and Industry of Romania, performs registrations and other operations in the National Registry of Movable Property.
What is the National Registry of Movable Property (RNPM)?
The RNPM is a unique national database, serving as a system for recording the priority of movable mortgages, as well as for publicity purposes. This database is structured by persons and movable goods. Through the RNPM, the registration of operations concerning movable mortgages, assimilated operations, other rights provided by law, and the publicity of these legal operations are ensured.
What Legal Operations Are Subject to Publicity in the RNPM Database?
The following legal operations are subject to publicity in the RNPM database:
- Guarantee, lease, consignment, sale-purchase contracts, and agricultural obligations
- Precautionary seizures
- Registrations related to public finance operations
- Registrations related to various types of goods:
- Motor vehicles
- Agricultural machinery, other than motor vehicles
- Receivables
- Bank accounts
- Shares/stock/securities/other financial instruments
- Insurance policies
- Universalities (stocks, going concerns, or other such universalities)
- Equipment/installations/other goods intended to serve the operation of an enterprise
- Forests to be cut
- Minerals to be extracted
- Harvests in general, and harvests to be collected
- Livestock, etc.
Who Can Request the Registration of a Security Notice in the RNPM Database?
Any secured creditor who, in order to obtain a priority ranking, wishes to make public the existence of a movable mortgage on an asset, according to the provisions of the Civil Code, must complete a mortgage notice form on paper or in electronic format. This form must then be submitted or transmitted to an authorized operator/agent of the RNPM, along with payment of the fee established by law and the corresponding tariff set by that operator.
Benefits and Advantages of Registrations
The creditor usually imposes several conditions on the loan beneficiary, or debtor. Some of these conditions always relate to the creditor's assurance that no other creditor has any right over the secured asset, and that no future creditor will be granted more extensive rights over the secured asset.
Benefits include:
- Priority over other creditors, including state and local budgets.
- Self-enforcement of guarantees (the creditor has the right to peacefully repossess the secured asset or through a judicial enforcement officer).
